Some immigration agents find irony 'embarrassing'

WASHINGTON - The labels inside the U.S. Border Patrol uniforms have been making many federal agents feel uneasy. It's not the fit or feel of the olive-green shirts and pants, but what their labels read: "Made in Mexico."
"It's embarrassing to be protecting the U.S.-Mexico border and be wearing a uniform made in Mexico," says T.J. Bonner, president of the National Border Patrol Council, a 6,500-member union.
Agents and lawmakers are concerned about the consequences if the uniforms for agents charged with combating illegal immigration fall into the hands of criminals or terrorists.
"If we're manufacturing uniforms in Mexico, what's to stop someone from walking across the border in a Border Patrol uniform?" asked Rep. John Carter, R-Texas. "How do you know who are our guys and who are their guys?"
House members are expected to consider new immigration and border security measures after the Thanksgiving congressional break.
Carter and Rep. Rick Renzi, R-Ariz., say they plan to press a measure that would require the uniforms be made in the United States.
Renzi said he wants Republican House leaders to include the requirement as part of an immigration enforcement measure expected to be introduced in early December.
For more than a year, the shirts and pants worn by agents and inspectors with U.S. Customs and Border Protection have been made in Mexico, and some complaints were made when they were initially distributed. The uniforms are supplied by VF Solutions of Nashville, Tenn., which subcontracts its work to plants in the United States, Mexico, Canada and the Dominican Republic.
"The principle of it seems almost like an oxymoron," said James Stack, the National Border Patrol Council's vice president for the region that includes Texas and New Mexico. "Most agents don't like it."
Customs officials say they haven't detected any security breaches or misuse of the uniforms. Strict security measures are in place, including on-site inspections at the Mexican plant. U.S. officials conducted a review in August, said a statement released Wednesday by Customs and Border Protection.
"Based on this review, a report will be submitted to the CBP commissioner for determination on the made-in-Mexico issue, and no decisions have been made at this point," the statement said.

Lawmakers Under Scrutiny in Probe of Lobbyist
Ney and DeLay Among the Members of Congress Said to Be a Focus of Abramoff Investigation

The Justice Department's wide-ranging investigation of former lobbyist Jack Abramoff has entered a highly active phase as prosecutors are beginning to move on evidence pointing to possible corruption in Congress and executive branch agencies, lawyers involved in the case said.
Prosecutors have already told one lawmaker, Rep. Robert W. Ney (R-Ohio), and his former chief of staff that they are preparing a possible bribery case against them, according to two sources knowledgeable about the matter who spoke on the condition of anonymity.
The 35 to 40 investigators and prosecutors on the Abramoff case are focused on at least half a dozen members of Congress, lawyers and others close to the probe said. The investigators are looking at payments made by Abramoff and his colleagues to the wives of some lawmakers and at actions taken by senior Capitol Hill aides, some of whom went to work for Abramoff at the law firm Greenberg Traurig LLP, lawyers and others familiar with the probe said.
Former House majority leader Tom DeLay (R), now facing separate campaign finance charges in his home state of Texas, is one of the members under scrutiny, the sources said. Sen. Conrad Burns (R-Mont.), Rep. John T. Doolittle (R-Calif.) and other members of Congress involved with Indian affairs, one of Abramoff's key areas of interest, are also said to be among them.
Prosecutions and plea deals have become more likely, the lawyers said, now that Abramoff's former partner -- public relations executive Michael Scanlon -- has agreed to plead guilty to conspiracy and to testify about gifts that he and his K Street colleagues showered on lawmakers, allegedly in exchange for official favors.
An attorney for DeLay, whose wife worked for a lobbying firm that received client referrals from Abramoff, said there was no connection between her work and congressional business. A spokesman for Doolittle, whose wife received payments from Abramoff's lobbying firm, also said there was no connection with her husband's position. Burns's office has said his actions were consistent with his support for improving conditions for Indian tribes.
Ney is the congressman whose name has surfaced most prominently in the Abramoff investigation. His spokesman and attorney have said for weeks that Ney has not been told he is a target of the inquiry, even while acknowledging that his office has received a grand jury subpoena and that his activities were mentioned in Scanlon's plea agreement.
But the sources said that during the third week of October prosecutors told Ney and his former chief of staff, Neil Volz, that they were preparing a bribery case based in part on activities that occurred in October 2000. Abramoff and another business partner, Adam Kidan, were also told that they are targets in that case, the sources said.
The five-year statute of limitations for filing charges based on those events expired last month; the prosecutors sought and received a waiver of the deadline from all four men while they continue their investigation, the sources said. Prosecutors are often able to obtain such waivers by giving the targets a choice of being indicted right away or granting more time to see if information might surface that exonerates them.
Ney's attorney, Mark H. Tuohey, did not return calls seeking comment on the waiver. Ney spokesman Brian Walsh said the office had no comment, as did a lawyer for Volz.
The attorneys of Abramoff and Kidan did not return calls seeking comment.
The events in 2000 that interest investigators are connected to the purchase by Abramoff and Kidan of SunCruz Casinos, owner of a fleet of Florida gambling boats. Ney twice placed comments in the Congressional Record about SunCruz, first criticizing its former owner when Abramoff and Kidan were in difficult purchase negotiations and then, in October, praising Kidan's new management. Abramoff and Kidan are facing trial in January on charges of defrauding lenders in their purchase of the casino boats.
The statute of limitations may also soon run out on a 2001 Super Bowl trip sponsored by SunCruz that sources said investigators have reviewed. The Washington Post reported earlier this year that aides to Burns and DeLay were ferried to Tampa on a SunCruz corporate jet arranged by Abramoff. Ney and his sons were invited to the 2001 Super Bowl outing, former Abramoff associates said, but did not go.
The Hill aides were treated to the game and a night of gambling on a Sun Cruz ship. They were offered $500 in gambling chips, sources knowledgeable about the trip said.
The Post has reported that Burns, who received $137,000 in contributions from Abramoff lobbyists and their tribal clients, obtained a controversial $3 million school construction grant for one of Abramoff's wealthy tribal clients after pressuring the Bureau of Indian Affairs.
Investigators are also gathering information about Abramoff's hiring of several congressional wives, sources said, as well as his referral of clients to Alexander Strategy Group, a lobbying and consulting firm run by former senior aides to DeLay. Financial disclosure forms show that the firm employed DeLay's wife, Christine, from 1998 to 2002.
Former Abramoff lobbying associates have said that Abramoff shared some of his high-paying clients with the group, including Malaysian interests, the Mississippi Choctaw Indian tribe and online gambling firms. Federal investigators have questioned some former Abramoff associates about whether those referrals were related to Christine DeLay's employment there, sources said.
Alexander Strategy Group is run by former DeLay senior staffers Edwin A. Buckham and Tony C. Rudy. Rudy served as DeLay's deputy chief of staff until 2001, when he took a job with Abramoff, and later moved on to join Buckham.
Investigators are looking into whether Rudy aided Abramoff's lobbying clients while he was working on the Hill, the sources said, and are reviewing payments from Abramoff clients and associates to Liberty Consulting, a political firm founded by Rudy's wife, Lisa. The Washington Post reported last month that Rudy, while on DeLay's staff, helped scuttle a bill opposed by eLottery Inc., an Abramoff client, and that Abramoff had eLottery pay a foundation to hire Liberty Consulting.
Richard Cullen, an attorney for the DeLays, said Christine DeLay was hired by Buckham, an old family friend, to determine the favorite charity of every member of Congress. She was paid $3,200 to $3,400 a month for three years, or about $115,000 total, he said.
"It wasn't like she did this 9 to 5, but it was an ongoing project," Cullen said. He said Christine DeLay's work was commensurate with the project and had nothing to do with her husband or any official congressional business. "This was something that she found to be very interesting, very challenging and very worthwhile," Cullen said.
Rudy and Buckham and their attorneys did not return calls seeking comment.
Abramoff's connections to Doolittle are also of interest to investigators, sources said. Doolittle's former chief of staff, Kevin A. Ring, went to work with Abramoff. Doolittle's wife, Julie, owned a consulting firm that was hired by Abramoff and his firm, Greenberg Traurig, to do fundraising for a charity he founded. Two sources close to the investigation said that Ring, while working for Abramoff, was an intermediary in the hiring of Julie Doolittle's firm, Sierra Dominion Financial Solutions Inc., which last year received a subpoena from the grand jury investigating Abramoff.
Julie Doolittle's attorney, William L. Stauffer Jr., said Sierra Dominion Financial was hired by Greenberg Traurig to provide "event planning, marketing and related services, as requested by Mr. Abramoff" for Abramoff's Capital Athletic Foundation and his Signatures restaurant. Sierra Dominion received a monthly retainer from Greenberg Traurig from January 2003 until February 2004, at a rate similar to that paid by other Sierra Dominion clients, Stauffer said.
Abramoff frequently used the athletic foundation as a pass-through organization to run lobbying efforts and to pay for expenses, records show. Julie Doolittle was hired to put on a fundraiser for the foundation at the International Spy Museum, but the event was canceled because it had been scheduled to take place just at the Iraq war was commencing, Stauffer said.
"Sierra Dominion primarily performed public relations and other event planning services for the Spy Museum event," Stauffer said in an e-mail reply to questions. "This included responding to all individuals calling the Capital Athletic Foundation concerning the Spy Museum event, identifying (and contacting) possible attendees for the event, and assisting in fund raising strategy and letters."
Doolittle's office denied any connection between the firm's work and official acts.
"In no way did Sierra Dominion's business services work for Greenberg Traurig have any relationship to Congressman Doolittle's official duties as a member of the House of Representatives," said Doolittle spokeswoman Laura Blackmann.
"Congressman Doolittle has never received a subpoena regarding this matter, nor has he ever been contacted by the Justice Department to provide information or be questioned," she said.
The Justice Department investigation is also looking into Abramoff's influence among executive branch officials. Sources said prosecutors are continuing to seek information about Abramoff's dealings with then-Deputy Interior Secretary J. Steven Griles, including a job offer from the lobbyist at a time when he was seeking department actions on behalf of his tribal clients.
The former top procurement official in the Bush administration, David H. Safavian, has already been charged with lying and obstruction of justice in connection with the Abramoff investigation. Safavian, who traveled to Scotland with Ney on a golf outing arranged by Abramoff, is accused of concealing from federal investigators that Abramoff was seeking to do business with the General Services Administration at the time of the golf trip. Safavian was then GSA chief of staff.

Calif. Congressman Admits Taking Bribes

Rep. Randy "Duke" Cunningham pleaded guilty Monday to conspiracy and tax charges, admitting taking $2.4 million in bribes in a case that grew from an investigation into the sale of his home to a wide-ranging conspiracy involving payments in cash, vacations and antiques.
Cunningham, 63, entered pleas in U.S. District Court to charges of conspiracy to commit bribery, mail fraud and wire fraud, and tax evasion for underreporting his income in 2004.
Cunningham answered "yes, Your Honor" when asked by U.S. District Judge Larry Burns if he had accepted bribes from someone in exchange for his performance of official duties.
Cunningham, an eight-term Republican congressman, announced in July that he wouldn't seek re-election next year. But it was not immediately clear whether he hoped to keep his seat for the remainder of the current term. He planned to address reporters at a news conference later in the morning.
House Ethics rules say that any lawmaker convicted of a felony no longer should vote or participate in committee work. Under Republican caucus rules, Cunningham also would lose his chairmanship of the House Intelligence subcommittee on terrorism and human intelligence.
The former Vietnam War flying ace is known on Capitol Hill for his interest in defense issues and his occasional temperamental outbursts.
After the hearing, Cunningham was taken away for fingerprinting. He will be released on his own recognizance until a Feb. 27 sentencing hearing. He could receive a maximum sentence of 10 years in prison.
He also agreed to forfeit to the government his Rancho Santa Fe home, more than $1.8 million in cash and antiques and rugs.
In a statement, prosecutors said Cunningham admitted to receiving at least $2.4 million in bribes paid to him by several conspirators through a variety of methods, including checks totaling over $1 million, cash, rugs, antiques, furniture, yacht club fees and vacations.
"He did the worst thing an elected official can do — he enriched himself through his position and violated the trust of those who put him there," U.S. Attorney Carol Lam said. The statement did not identify the conspirators.
The case began when authorities started investigating whether Cunningham and his wife, Nancy, used the proceeds from the $1,675,000 sale to defense contractor Mitchell Wade to buy a $2.55 million mansion in ritzy Rancho Santa Fe. Wade put the Del Mar house back on the market and sold it after nearly a year for $975,000 — a loss of $700,000.
He drew little notice outside his San Diego-area district before the San Diego Union-Tribune reported last June that he'd sold the home to Wade.
Cunningham's pleas came amid a series of GOP scandals. Rep. Tom DeLay of Texas had to step down as majority leader after he was indicted in a campaign finance case; a stock sale by Senate Majority Leader Bill Frist is being looked at by regulators; and Vice President Dick Cheney's chief of staff was indicted in the CIA leak case.

The most frightening aspect of the two articles below is that the United States is stuck with three more years of flailing, rudderless, self-deluded and utterly clueless "leadership" from a man who, a generation ago, would have been laughed out of the political process in his first campaign for Congress. Exactly who is to blame for the fact that George W. Bush is President of the United States? The 50+ million Americans who allowed themselves to be conned into voting for him, not once but twice? The corporate media for giving him a free ride between 1999 and 2005? The "neocons" who put him up as a genial mask for their ageda of evil? All of the above?
Whomever the culprits, it is the country, and the world, that has and will continue to suffer under the yoke of this presidency. Hopefully the damage will not be irreversible.

WASHINGTON - Embattled White House aides have begun to believe President Bush must take the reins personally if his evaporating agenda and credibility are to be salvaged.
"We're just plodding along," admitted a senior Bush aide from deep within the West Wing bunker. "It's up to the President to turn things around now."
Even as his poll numbers tank, however, Bush is described by aides as still determined to stay the course. He resists advice from Republicans who fear disaster in next year's congressional elections, and rejects criticism from a media establishment he disdains.
"The President has always been willing to make changes," the senior aide said, "but not because someone in this town tells him to - NEVER!"
For the moment, Bush has dismissed discreetly offered advice from friends and loyalists to fire Secretary of Defense Donald Rumsfeld and bring back longtime confidant Karen Hughes from the State Department to shore up his personal White House staff.
"He thinks that would be an admission he's screwed up, and he can't bring himself to do that," a former senior staffer lamented.
So aides have circled the wagons as Bush's woes mount, partly hoping they can sell the President on a December blitz of media interviews to help turn the tide.
"The staff basically still has an unyielding belief in the wisdom of what they're doing," a close Bush confidant said. "They're talking to people who could help them, but they're not listening."
Two sources said Bush has not only lost some confidence in his top aides, as the Daily News has previously reported, but is furious with a stream of leaks about the mood within the West Wing.
"He's asking [friends] for opinions on who he can trust and who he can't," one knowledgeable source said.
Much to Bush's relief, political mastermind Karl Rove is said to be engaged in day-to-day strategy, even though he still could be indicted in the CIA leak case. Some in the White House think Rove is a continuing drain and has also hurt Bush's recovery by not clearing the reputation of spokesman Scott McClellan, who repeatedly told reporters Rove assured him he had nothing to do with leaking covert agent Valerie Plame's name, even though it's now clear he did.
The problem for Bush, advisers admit, is that the ongoing leak probe reinforces allegations that the White House allegedly hyped prewar intelligence to justify a war most Americans no longer support.
So far Team Bush doesn't know how to separate the two issues, and compounding its woes is the fact that aides aren't talking to each other as much as they once did.
Gone from the schedule are weekly cholesterol-laden breakfasts at Rove's home where top Bush hands discussed strategy. Also missing are Sunday "message meetings" with outside thinkers like GOP Chairman Ken Mehlman, campaign pollster Matthew Dowd and superlobbyist Ed Gillespie.
A card-carrying member of the Washington GOP establishment with close ties to the White House recently encountered several senior presidential aides at a dinner and came away shaking his head at their "no problems here" mentality.
"There is just no introspection there at all," he said in exasperation. "It is everybody else's fault - the press, gutless Republicans on the Hill. They're still in denial."
Not ready to throw in the towel and declare the boss a lame duck, the Bushies are hoping two issues can help firm up their base and perhaps make inroads with centrists who voted for Bush: the anticipated confirmation of Supreme Court nominee Samuel Alito, and a plan to reinforce the border with Mexico to help stop illegal immigration.
This week Bush will begin to press the border security issue, while Alito's Senate confirmation hearings start early next year. Aides hope those issues will draw attention away from the war and leak probe. |

Where is the Iraq war headed next?

In recent weeks, there has been widespread speculation that President George W. Bush, confronted by diminishing approval ratings and dissent within his own party, will begin pulling American troops out of Iraq next year. The Administration’s best-case scenario is that the parliamentary election scheduled for December 15th will produce a coalition government that will join the Administration in calling for a withdrawal to begin in the spring. By then, the White House hopes, the new government will be capable of handling the insurgency. In a speech on November 19th, Bush repeated the latest Administration catchphrase: “As Iraqis stand up, we will stand down.” He added, “When our commanders on the ground tell me that Iraqi forces can defend their freedom, our troops will come home with the honor they have earned.” One sign of the political pressure on the Administration to prepare for a withdrawal came last week, when Secretary of State Condoleezza Rice told Fox News that the current level of American troops would not have to be maintained “for very much longer,” because the Iraqis were getting better at fighting the insurgency.
A high-level Pentagon war planner told me, however, that he has seen scant indication that the President would authorize a significant pullout of American troops if he believed that it would impede the war against the insurgency. There are several proposals currently under review by the White House and the Pentagon; the most ambitious calls for American combat forces to be reduced from a hundred and fifty-five thousand troops to fewer than eighty thousand by next fall, with all American forces officially designated “combat” to be pulled out of the area by the summer of 2008. In terms of implementation, the planner said, “the drawdown plans that I’m familiar with are condition-based, event-driven, and not in a specific time frame”—that is, they depend on the ability of a new Iraqi government to defeat the insurgency. (A Pentagon spokesman said that the Administration had not made any decisions and had “no plan to leave, only a plan to complete the mission.”)
A key element of the drawdown plans, not mentioned in the President’s public statements, is that the departing American troops will be replaced by American airpower. Quick, deadly strikes by U.S. warplanes are seen as a way to improve dramatically the combat capability of even the weakest Iraqi combat units. The danger, military experts have told me, is that, while the number of American casualties would decrease as ground troops are withdrawn, the over-all level of violence and the number of Iraqi fatalities would increase unless there are stringent controls over who bombs what.
“We’re not planning to diminish the war,” Patrick Clawson, the deputy director of the Washington Institute for Near East Policy, told me. Clawson’s views often mirror the thinking of the men and women around Vice-President Dick Cheney and Defense Secretary Donald Rumsfeld. “We just want to change the mix of the forces doing the fighting—Iraqi infantry with American support and greater use of airpower. The rule now is to commit Iraqi forces into combat only in places where they are sure to win. The pace of commitment, and withdrawal, depends on their success in the battlefield.”
He continued, “We want to draw down our forces, but the President is prepared to tough this one out. There is a very deep feeling on his part that the issue of Iraq was settled by the American people at the polling places in 2004.” The war against the insurgency “may end up being a nasty and murderous civil war in Iraq, but we and our allies would still win,” he said. “As long as the Kurds and the Shiites stay on our side, we’re set to go. There’s no sense that the world is caving in. We’re in the middle of a seven-year slog in Iraq, and eighty per cent of the Iraqis are receptive to our message.”
One Pentagon adviser told me, “There are always contingency plans, but why withdraw and take a chance? I don’t think the President will go for it”—until the insurgency is broken. “He’s not going to back off. This is bigger than domestic politics.” 
Current and former military and intelligence officials have told me that the President remains convinced that it is his personal mission to bring democracy to Iraq, and that he is impervious to political pressure, even from fellow Republicans. They also say that he disparages any information that conflicts with his view of how the war is proceeding.
Bush’s closest advisers have long been aware of the religious nature of his policy commitments. In recent interviews, one former senior official, who served in Bush’s first term, spoke extensively about the connection between the President’s religious faith and his view of the war in Iraq. After the September 11, 2001, terrorist attacks, the former official said, he was told that Bush felt that “God put me here” to deal with the war on terror. The President’s belief was fortified by the Republican sweep in the 2002 congressional elections; Bush saw the victory as a purposeful message from God that “he’s the man,” the former official said. Publicly, Bush depicted his reëlection as a referendum on the war; privately, he spoke of it as another manifestation of divine purpose.
The former senior official said that after the election he made a lengthy inspection visit to Iraq and reported his findings to Bush in the White House: “I said to the President, ‘We’re not winning the war.’ And he asked, ‘Are we losing?’ I said, ‘Not yet.’ ” The President, he said, “appeared displeased” with that answer.
“I tried to tell him,” the former senior official said. “And he couldn’t hear it.”
There are grave concerns within the military about the capability of the U.S. Army to sustain two or three more years of combat in Iraq. Michael O’Hanlon, a specialist on military issues at the Brookings Institution, told me, “The people in the institutional Army feel they don’t have the luxury of deciding troop levels, or even participating in the debate. They’re planning on staying the course until 2009. I can’t believe the Army thinks that it will happen, because there’s no sustained drive to increase the size of the regular Army.” O’Hanlon noted that “if the President decides to stay the present course in Iraq some troops would be compelled to serve fourth and fifth tours of combat by 2007 and 2008, which could have serious consequences for morale and competency levels.”
Many of the military’s most senior generals are deeply frustrated, but they say nothing in public, because they don’t want to jeopardize their careers. The Administration has “so terrified the generals that they know they won’t go public,” a former defense official said. A retired senior C.I.A. officer with knowledge of Iraq told me that one of his colleagues recently participated in a congressional tour there. The legislators were repeatedly told, in meetings with enlisted men, junior officers, and generals that “things were fucked up.” But in a subsequent teleconference with Rumsfeld, he said, the generals kept those criticisms to themselves.
One person with whom the Pentagon’s top commanders have shared their private views for decades is Representative John Murtha, of Pennsylvania, the senior Democrat on the House Defense Appropriations Subcommittee. The President and his key aides were enraged when, on November 17th, Murtha gave a speech in the House calling for a withdrawal of troops within six months. The speech was filled with devastating information. For example, Murtha reported that the number of attacks in Iraq has increased from a hundred and fifty a week to more than seven hundred a week in the past year. He said that an estimated fifty thousand American soldiers will suffer “from what I call battle fatigue” in the war, and he said that the Americans were seen as “the common enemy” in Iraq. He also took issue with one of the White House’s claims—that foreign fighters were playing the major role in the insurgency. Murtha said that American soldiers “haven’t captured any in this latest activity”—the continuing battle in western Anbar province, near the border with Syria. “So this idea that they’re coming in from outside, we still think there’s only seven per cent.”
Murtha’s call for a speedy American pullout only seemed to strengthen the White House’s resolve. Administration officials “are beyond angry at him, because he is a serious threat to their policy—both on substance and politically,” the former defense official said. Speaking at the Osan Air Force base, in South Korea, two days after Murtha’s speech, Bush said, “The terrorists regard Iraq as the central front in their war against humanity. . . . If they’re not stopped, the terrorists will be able to advance their agenda to develop weapons of mass destruction, to destroy Israel, to intimidate Europe, and to break our will and blackmail our government into isolation. I’m going to make you this commitment: this is not going to happen on my watch.”
“The President is more determined than ever to stay the course,” the former defense official said. “He doesn’t feel any pain. Bush is a believer in the adage ‘People may suffer and die, but the Church advances.’ ” He said that the President had become more detached, leaving more issues to Karl Rove and Vice-President Cheney. “They keep him in the gray world of religious idealism, where he wants to be anyway,” the former defense official said. Bush’s public appearances, for example, are generally scheduled in front of friendly audiences, most often at military bases. Four decades ago, President Lyndon Johnson, who was also confronted with an increasingly unpopular war, was limited to similar public forums. “Johnson knew he was a prisoner in the White House,” the former official said, “but Bush has no idea.” 
Within the military, the prospect of using airpower as a substitute for American troops on the ground has caused great unease. For one thing, Air Force commanders, in particular, have deep-seated objections to the possibility that Iraqis eventually will be responsible for target selection. “Will the Iraqis call in air strikes in order to snuff rivals, or other warlords, or to snuff members of your own sect and blame someone else?” another senior military planner now on assignment in the Pentagon asked. “Will some Iraqis be targeting on behalf of Al Qaeda, or the insurgency, or the Iranians?”
“It’s a serious business,” retired Air Force General Charles Horner, who was in charge of allied bombing during the 1991 Gulf War, said. “The Air Force has always had concerns about people ordering air strikes who are not Air Force forward air controllers. We need people on active duty to think it out, and they will. There has to be training to be sure that somebody is not trying to get even with somebody else.” (Asked for a comment, the Pentagon spokesman said there were plans in place for such training. He also noted that Iraq had no offensive airpower of its own, and thus would have to rely on the United States for some time.)
The American air war inside Iraq today is perhaps the most significant—and underreported—aspect of the fight against the insurgency. The military authorities in Baghdad and Washington do not provide the press with a daily accounting of missions that Air Force, Navy, and Marine units fly or of the tonnage they drop, as was routinely done during the Vietnam War. One insight into the scope of the bombing in Iraq was supplied by the Marine Corps during the height of the siege of Falluja in the fall of 2004. “With a massive Marine air and ground offensive under way,” a Marine press release said, “Marine close air support continues to put high-tech steel on target. . . . Flying missions day and night for weeks, the fixed wing aircraft of the 3rd Marine Aircraft Wing are ensuring battlefield success on the front line.” Since the beginning of the war, the press release said, the 3rd Marine Aircraft Wing alone had dropped more than five hundred thousand tons of ordnance. “This number is likely to be much higher by the end of operations,” Major Mike Sexton said. In the battle for the city, more than seven hundred Americans were killed or wounded; U.S. officials did not release estimates of civilian dead, but press reports at the time told of women and children killed in the bombardments.
In recent months, the tempo of American bombing seems to have increased. Most of the targets appear to be in the hostile, predominantly Sunni provinces that surround Baghdad and along the Syrian border. As yet, neither Congress nor the public has engaged in a significant discussion or debate about the air war.
The insurgency operates mainly in crowded urban areas, and Air Force warplanes rely on sophisticated, laser-guided bombs to avoid civilian casualties. These bombs home in on targets that must be “painted,” or illuminated, by laser beams directed by ground units. “The pilot doesn’t identify the target as seen in the pre-brief”—the instructions provided before takeoff—a former high-level intelligence official told me. “The guy with the laser is the targeteer. Not the pilot. Often you get a ‘hot-read’ ”—from a military unit on the ground—“and you drop your bombs with no communication with the guys on the ground. You don’t want to break radio silence. The people on the ground are calling in targets that the pilots can’t verify.” He added, “And we’re going to turn this process over to the Iraqis?”
The second senior military planner told me that there are essentially two types of targeting now being used in Iraq: a deliberate site-selection process that works out of air-operations centers in the region, and “adaptive targeting”—supportive bombing by prepositioned or loitering warplanes that are suddenly alerted to firefights or targets of opportunity by military units on the ground. “The bulk of what we do today is adaptive,” the officer said, “and it’s divorced from any operational air planning. Airpower can be used as a tool of internal political coercion, and my attitude is that I can’t imagine that we will give that power to the Iraqis.”
This military planner added that even today, with Americans doing the targeting, “there is no sense of an air campaign, or a strategic vision. We are just whacking targets—it’s a reversion to the Stone Age. There’s no operational art. That’s what happens when you give targeting to the Army—they hit what the local commander wants to hit.”
One senior Pentagon consultant I spoke to said he was optimistic that “American air will immediately make the Iraqi Army that much better.” But he acknowledged that he, too, had concerns about Iraqi targeting. “We have the most expensive eyes in the sky right now,” the consultant said. “But a lot of Iraqis want to settle old scores. Who is going to have authority to call in air strikes? There’s got to be a behavior-based rule.”
General John Jumper, who retired last month after serving four years as the Air Force chief of staff, was “in favor of certification of those Iraqis who will be allowed to call in strikes,” the Pentagon consultant told me. “I don’t know if it will be approved. The regular Army generals were resisting it to the last breath, despite the fact that they would benefit the most from it.”
A Pentagon consultant with close ties to the officials in the Vice-President’s office and the Pentagon who advocated the war said that the Iraqi penchant for targeting tribal and personal enemies with artillery and mortar fire had created “impatience and resentment” inside the military. He believed that the Air Force’s problems with Iraqi targeting might be addressed by the formation of U.S.-Iraqi transition teams, whose American members would be drawn largely from Special Forces troops. This consultant said that there were plans to integrate between two hundred and three hundred Special Forces members into Iraqi units, which was seen as a compromise aimed at meeting the Air Force’s demand to vet Iraqis who were involved in targeting. But in practice, the consultant added, it meant that “the Special Ops people will soon allow Iraqis to begin calling in the targets.”
Robert Pape, a political-science professor at the University of Chicago, who has written widely on American airpower, and who taught for three years at the Air Force’s School of Advanced Airpower Studies, in Alabama, predicted that the air war “will get very ugly” if targeting is turned over to the Iraqis. This would be especially true, he said, if the Iraqis continued to operate as the U.S. Army and Marines have done—plowing through Sunni strongholds on search-and-destroy missions. “If we encourage the Iraqis to clear and hold their own areas, and use airpower to stop the insurgents from penetrating the cleared areas, it could be useful,” Pape said. “The risk is that we will encourage the Iraqis to do search-and-destroy, and they would be less judicious about using airpower—and the violence would go up. More civilians will be killed, which means more insurgents will be created.”
Even American bombing on behalf of an improved, well-trained Iraqi Army would not necessarily be any more successful against the insurgency. “It’s not going to work,” said Andrew Brookes, the former director of airpower studies at the Royal Air Force’s advanced staff college, who is now at the International Institute for Strategic Studies, in London. “Can you put a lid on the insurgency with bombing?” Brookes said. “No. You can concentrate in one area, but the guys will spring up in another town.” The inevitable reliance on Iraqi ground troops’ targeting would also create conflicts. “I don’t see your guys dancing to the tune of someone else,” Brookes said. He added that he and many other experts “don’t believe that airpower is a solution to the problems inside Iraq at all. Replacing boots on the ground with airpower didn’t work in Vietnam, did it?” 
The Air Force’s worries have been subordinated, so far, to the political needs of the White House. The Administration’s immediate political goal after the December elections is to show that the day-to-day conduct of the war can be turned over to the newly trained and equipped Iraqi military. It has already planned heavily scripted change-of-command ceremonies, complete with the lowering of American flags at bases and the raising of Iraqi ones.
Some officials in the State Department, the C.I.A., and British Prime Minister Tony Blair’s government have settled on their candidate of choice for the December elections—Iyad Allawi, the secular Shiite who served until this spring as Iraq’s interim Prime Minister. They believe that Allawi can gather enough votes in the election to emerge, after a round of political bargaining, as Prime Minister. A former senior British adviser told me that Blair was convinced that Allawi “is the best hope.” The fear is that a government dominated by religious Shiites, many of whom are close to Iran, would give Iran greater political and military influence inside Iraq. Allawi could counter Iran’s influence; also, he would be far more supportive and coöperative if the Bush Administration began a drawdown of American combat forces in the coming year.
Blair has assigned a small team of operatives to provide political help to Allawi, the former adviser told me. He also said that there was talk late this fall, with American concurrence, of urging Ahmad Chalabi, a secular Shiite, to join forces in a coalition with Allawi during the post-election negotiations to form a government. Chalabi, who is notorious for his role in promoting flawed intelligence on weapons of mass destruction before the war, is now a deputy Prime Minister. He and Allawi were bitter rivals while in exile.
A senior United Nations diplomat told me that he was puzzled by the high American and British hopes for Allawi. “I know a lot of people want Allawi, but I think he’s been a terrific disappointment,” the diplomat said. “He doesn’t seem to be building a strong alliance, and at the moment it doesn’t look like he will do very well in the election.”
The second Pentagon consultant told me, “If Allawi becomes Prime Minister, we can say, ‘There’s a moderate, urban, educated leader now in power who does not want to deprive women of their rights.’ He would ask us to leave, but he would allow us to keep Special Forces operations inside Iraq—to keep an American presence the right way. Mission accomplished. A coup for Bush.”
A former high-level intelligence official cautioned that it was probably “too late” for any American withdrawal plan to work without further bloodshed. The constitution approved by Iraqi voters in October “will be interpreted by the Kurds and the Shiites to proceed with their plans for autonomy,” he said. “The Sunnis will continue to believe that if they can get rid of the Americans they can still win. And there still is no credible way to establish security for American troops.”
The fear is that a precipitous U.S. withdrawal would inevitably trigger a Sunni-Shiite civil war. In many areas, that war has, in a sense, already begun, and the United States military is being drawn into the sectarian violence. An American Army officer who took part in the assault on Tal Afar, in the north of Iraq, earlier this fall, said that an American infantry brigade was placed in the position of providing a cordon of security around the besieged city for Iraqi forces, most of them Shiites, who were “rounding up any Sunnis on the basis of whatever a Shiite said to them.” The officer went on, “They were killing Sunnis on behalf of the Shiites,” with the active participation of a militia unit led by a retired American Special Forces soldier. “People like me have gotten so downhearted,” the officer added.
Meanwhile, as the debate over troop reductions continues, the covert war in Iraq has expanded in recent months to Syria. A composite American Special Forces team, known as an S.M.U., for “special-mission unit,” has been ordered, under stringent cover, to target suspected supporters of the Iraqi insurgency across the border. (The Pentagon had no comment.) “It’s a powder keg,” the Pentagon consultant said of the tactic. “But, if we hit an insurgent network in Iraq without hitting the guys in Syria who are part of it, the guys in Syria would get away. When you’re fighting an insurgency, you have to strike everywhere—and at once.”

2nd Time Reporter to Testify in Leak Case
WASHINGTON, Nov. 27 - A second reporter for Time magazine has been asked to testify under oath in the C.I.A. leak case, about conversations she had in 2004 with a lawyer for Karl Rove, the senior White House adviser, the magazine reported on Sunday.
The reporter, Viveca Novak, who has written about the leak investigation, has been asked to testify by the special counsel in the case, Patrick J. Fitzgerald, about her conversations with Robert D. Luskin, a lawyer for Mr. Rove, the magazine said.
The request for Ms. Novak's testimony is the first tangible sign in weeks that Mr. Fitzgerald has not completed his inquiry into Mr. Rove's actions and may still be considering charges against him. Mr. Rove has long been under scrutiny in the case but has not been accused of any wrongdoing.
So far, Mr. Fitzgerald has brought one indictment, on perjury and obstruction of justice charges, against I. Lewis Libby Jr., the chief of staff to Vice President Dick Cheney. Mr. Libby resigned after the indictment was announced and has pleaded not guilty to the charges.
Mr. Fitzgerald's request for Ms. Novak's testimony follows a disclosure by The Washington Post on Nov. 16 that its best-known reporter, Bob Woodward, had testified under oath to Mr. Fitzgerald about matters that lawyers in the case said were unrelated to Mr. Rove.
In an article and a first-person account by Mr. Woodward, the paper reported that an unidentified administration official told Mr. Woodward about the C.I.A. officer at the heart of the case in June 2003, making him the first reporter to learn of the intelligence officer.
Time magazine did not make clear what information the prosecutor hoped to obtain from Ms. Novak, whose name has not previously surfaced in the case. She has contributed to articles in which Mr. Luskin was quoted.
Another Time reporter, Matthew Cooper, testified this summer about a July 2003 conversation he had with Mr. Rove, but only after the magazine waged a lengthy legal battle.
Time disclosed the prosecutor's request in a two-paragraph article published on Sunday, reporting that Ms. Novak had been asked to discuss conversations she had with Mr. Luskin, starting in May 2004, when she was covering the investigation.
The article said Ms. Novak was cooperating with the inquiry. It is not known when she will testify; she has not been asked to appear before the grand jury but will instead give a deposition, said Ty Trippet, a Time spokesman.
On Sunday, Mr. Luskin declined to comment, but he has previously said he expects that Mr. Fitzgerald will decide not to prosecute Mr. Rove. Ms. Novak declined to comment, as did Randall Samborn, a spokesman for Mr. Fitzgerald.
The lawyers who discussed the case would do so only if they were not identified by name, citing Mr. Fitzgerald's requests to them not to publicly discuss matters that remain under investigation.
Ms. Novak is not known to have had discussions with Mr. Rove or other White House officials about the C.I.A. officer during the summer of 2003, the time that has been the focus of Mr. Fitzgerald's inquiry.
Nevertheless, the summer and fall of 2004 was a significant time for Mr. Rove, according to lawyers in the case. It was then that Mr. Rove searched for and found an e-mail message he had written that led him to recall the July 2003 conversation with Mr. Cooper, the lawyers said.
Mr. Rove's e-mail message was sent on July 11, 2003, to Stephen J. Hadley, who was then the deputy national security adviser. The message said Mr. Rove had spoken to Mr. Cooper about issues in the leak case.
After its discovery, Mr. Rove provided the message to Mr. Fitzgerald, who had not been aware of it. Mr. Rove testified about the conversation with Mr. Cooper in a grand jury appearance in October 2004.
Even so, Mr. Fitzgerald has investigated Mr. Rove's assertions that he had forgotten the conversation with Mr. Cooper, and why he made no mention of it in his earlier testimony and in meetings with investigators, the lawyers said.
In Ms. Novak's case, the magazine's apparently swift compliance contrasted with the legal battle waged by Time and Mr. Cooper, who for months resisted a subpoena from Mr. Fitzgerald for his testimony.
With his appeals exhausted, Mr. Cooper testified in July that he had spoken with Mr. Rove about Joseph C. Wilson IV, a former ambassador who traveled to Africa in early 2002 at the C.I.A.'s request to investigate claims of Iraqi efforts to acquire uranium ore. Mr. Wilson later became an ardent critic of the Bush administration's Iraq policy.
After his grand jury appearance, Mr. Cooper wrote that Mr. Rove did not identify Mr. Wilson's wife, Valerie Wilson, by name, but told him that she worked at the Central Intelligence Agency on issues related to illicit weapons and might have played a role in sending her husband on the Africa trip.
Ms. Novak is not related to the columnist Robert D. Novak, who first disclosed Ms. Wilson's identity in a column on July 14, 2003.
